1) Agreement to Terms

These Terms & Conditions (the “Terms”) govern your access to and use of blackericemanuelshorts.com (the “Site”) and any purchases made through the Site. By accessing, browsing, or purchasing from the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

We may update these Terms from time to time. The “Effective date” above reflects the latest revision. Your continued use after any update constitutes acceptance of the new Terms.

Independent reseller notice: We are an independent retailer and are not affiliated with, endorsed by, or sponsored by Eric Emanuel or EE, and all trademarks are the property of their respective owners.

2) Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order. By using the Site, you represent that you have the legal capacity to enter into a binding contract.

3) Products, Availability & Authenticity

We specialize in Eric Emanuel shorts with a focus on black staples and curated colorways. Inventory may be limited and subject to change without notice. All listings are offered on a first‑come, first‑served basis, and placing items in your cart does not reserve them.

Authenticity: We source products from trusted channels and authenticate before dispatch. If you believe an item is not as described, contact us within 48 hours of delivery with clear evidence so we can review in line with our Refund & Returns Policy.

4) Orders & Acceptance

Your order is an offer to purchase. We may accept, decline, or cancel any order for reasons including but not limited to: product unavailability, suspicion of fraud, pricing or listing errors, or payment issues. Acceptance occurs when we send a shipment confirmation email with tracking.

We reserve the right to limit quantities per order, per person, per household, or per address to protect limited releases and ensure fair access.

5) Pricing, Taxes & Duties

Prices are listed in USD unless otherwise stated. We try to ensure pricing is accurate but errors may occur. If we discover a pricing error after you place an order, we will notify you and give you the option to reconfirm at the correct price or cancel for a full refund.

Applicable sales taxes are calculated at checkout based on the shipping address. International orders (if offered) may be subject to import duties, taxes, and fees imposed by the destination country; these are the customer’s responsibility.

6) Payments

We accept major payment methods displayed at checkout. By submitting a payment, you represent that you are authorized to use the chosen method and authorize us (or our payment processor) to charge the full order amount, including taxes, shipping, and any applicable fees.

Orders may be cancelled if payment cannot be processed or is flagged for fraud review.

7) Shipping & Delivery

We process orders promptly during business days. Estimated delivery windows displayed at checkout are for convenience and are not guaranteed. Once a package is tendered to the carrier, risk of loss transfers to you. Please ensure your shipping address is accurate; we are not responsible for delays or losses due to incorrect addresses or carrier issues.

8) Returns, Exchanges & Cancellations

We offer free returns within 30 days on eligible items in original, unworn condition with all tags attached, unless marked final sale. Initiate a return using the instructions in our Refund & Returns Policy.

Cancellations: Orders may be cancelled prior to shipment by contacting support promptly. Once shipped, standard return procedures apply.

9) Pre‑orders & Special Releases

For pre‑orders or limited drops, ETA dates are estimates and subject to change. Payment may be captured at the time of order. If we cannot fulfill a pre‑order, you will receive a full refund to your original payment method.

10) Sizing, Condition & Images

Sizing guides are provided for reference and may vary slightly by batch or style. Product photos aim to reflect true color but can vary across screens and lighting. Where applicable, condition grades will be stated in the listing.

11) Promotions, Gift Cards & Discounts

Promotional codes must be used within their validity period and cannot be combined unless explicitly allowed. Promotions may exclude certain styles, collaborations, or new releases. We reserve the right to modify or end promotions at any time.

12) Accounts & Security

You may create an account to track orders and save preferences. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized access.

13) Acceptable Use

You agree not to: (a) use bots or automated scripts to place orders; (b) interfere with the Site’s operation; (c) attempt to bypass security; (d) use the Site for unlawful purposes; (e) scrape, copy, or mirror the Site without permission; or (f) misuse return labels or fraudulently claim non‑delivery.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product at issue.

17) Indemnification

18) Governing Law, Disputes & Arbitration

Binding arbitration: Any dispute that cannot be resolved informally will be submitted to binding arbitration on an individual basis under the rules of the American Arbitration Association. You and we waive any right to a jury trial or to participate in a class action. Venue for any court proceeding to compel arbitration or enforce an award will be in New York County, New York.

19) Changes to the Terms
